These terms apply to every order placed on www.mapsweb.com with MAPS, Inc., a Kansas corporation at 5001 S. 13th Street, Leavenworth, KS 66048 (“MAPS”). By placing an order, you accept them.
1. Orders. An order is an offer to buy. MAPS accepts it when we confirm it or ship it. We may decline or cancel any order, including one placed at a price shown in error, and we will refund any payment taken for a canceled order.
2. Prices. Prices are in U.S. dollars and can change without notice. Public prices follow manufacturer advertised-price policies. Account and contract pricing applies only when you are signed in to an approved account. Sales tax is added where required. Tax-exempt customers must have a valid exemption certificate on file before the order ships.
3. Payment. We accept major credit cards and ACH. Purchase orders and net terms are available only after MAPS approves credit. Invoices on approved terms are due within the stated term. Past-due balances accrue 1.5% per month or the highest rate the law allows, whichever is lower. MAPS may hold shipments on past-due accounts.
4. Shipping and delivery. Our Shipping Policy describes methods, costs and delivery. Delivery dates are estimates. Ownership and risk of loss pass to you when the order is delivered to the carrier. MAPS will help you file any carrier claim.
5. Inspection and claims. Inspect deliveries promptly. Report damage, shortages or the wrong item within 2 business days of delivery. After that, the shipment is treated as accepted, subject to the Returns Policy.
6. Returns. Returns follow our Returns Policy.
7. Warranties. Products carry their manufacturer’s warranty, which MAPS passes through to you. Compatible and remanufactured supplies are labeled as such and carry their maker’s warranty. MAPS service plans and PrintMatrix® programs are sold under their own agreements. Except as stated in this section, MAPS makes no other warranties, express or implied, including merchantability and fitness for a particular purpose, to the extent the law allows.
8. Limitation of liability. MAPS’s total liability for any claim about a product is limited to the amount you paid for that product. MAPS is not liable for indirect, incidental, special or consequential damages, including lost profits or lost data.
9. Accounts. You are responsible for activity under your account and its users. Keep login details secure and tell us promptly about any unauthorized use.
10. Public agencies. Where a public agency buys under its own required terms or a cooperative contract MAPS participates in, those terms control where they conflict with these.
11. Law and venue. Kansas law governs these terms. Disputes will be heard in the state or federal courts serving Leavenworth County, Kansas.
12. Changes. MAPS may update these terms. The version posted when you place an order applies to that order.
